LATTIMORE, Judge.

Appellant was convicted in the Criminal District Court of Tarrant County, Texas, of the offense of murder, and his punishment fixed at confinement in the penitentiary for a period of ten years.

An extended statement of the facts in this case would serve no useful purpose. All parties to the transaction were negroes, and the homicide occurred in front of a negro restaurant, above which was a social club frequented by members of the same race.
