KRUEGER, Judge.

The offense is murder. The punishment assessed is confinement in the state penitentiary for a term of forty years.

Appellant’s first contention is that the trial court erred in declining to sustain his motion to quash the. indictment based on the ground of alleged race discrimination in the selection of the grand jury which returned the indictment in this case.
