Appellant, the People of the State of Colorado, initiated a delinquency proceeding against appellee R.M.D. and others in the Arapahoe County District Court, pursuant to section 19—3—101(l)(b), 8B C.R.S. (1986). The petition alleged that R.M.D. committed the offense of theft of merchandise valued at less than fifty dollars, in violation of section 18-4-401, 8B C.R.S. (1986). During the course of the juvenile proceedings the trial court entered an order declaring that section 18-4-406, 8B C.R.S.
