We granted the state’s petition for review of a decision of the court of appeals affirming a pretrial order of the district court suppressing evidence on Fourth Amendment grounds and dismissing certain criminal charges. The court of appeals held that the police violated Payton v. New York, 445 U.S. 573, 100 S.Ct. 1371, 63 L.Ed.2d 639 (1980), in entering defendant’s home without a warrant in order to investigate and, ultimately, arresting defendant for the felony offense of criminal vehicular operation, Minn.Stat. § 609.21 (1986).
