This was an action to recover on an insurance policy issued by a mutual fire insurance company. Plaintiff prevailed, and defendant appealed.

The issues were developed by the pleadings, which included a copy of plaintiff’s application for insurance, the bylaws, and the policy. The term was for three years from April 21, 1936. The *59premium thereon, $36.80, was paid. The insured property was a dwelling house and barn on an eighty-acre farm in Jackson county owned by Ora O. Reser and Elsia B. Reser, his wife.
