GOLDBERG, Circuit Judge:

Imitation may be the sincerest form of flattery, but it may also lead to jealousy when the imitator succeeds where the imitated does not. In this case, the object of imitation is a rock and roll song.

The appellants, members of the rock and roll band the Nightcaps, claim that the appel-lees, members of the rock and roll band ZZ Top, are copycats and stole the song Thunderbird from them.
