Appeal by the plaintiff, Michael Hart, from a judgment of the Municipal Court of the city of New York, borough of Brooklyn, in favor of the defendant, entered on the 10th day of July, 1901, dismissing the complaint.

Woodward, J.:
This action was brought originally in the borough of Manhattan to recover damages for personal injuries. The judgment for the defendant, entered upon the verdict of a jury, was reversed on appeal, and the case was sent to the fourth district, borough of Brooklyn, for a new trial, plaintiff having, in the meantime, become a resident of such district.
