after -stating the case- as above reported,-delivered the opinion of the court..
We will not extend this opinion by a recital.of all the facts and circumstances established by the proof. It is sufficient to say that there was evidence tending to sustain both the allegations of the complaint and the averments in the answer. In view of the serious conflict in the statements of witnesses, the case'was one peculiarly for the determination of a jury, under appropriate instructions as to the law.
