This medical malpractice case arises under the Federal Tort Claims Act, 28 U.S.C. §§ 1346(b), 2671 et seq. Plaintiff claims he was rendered impotent as the result of an operation performed by a government physician at the United States Public Health Service Hospital in Norfolk, Virginia. Although the plaintiff does not contend that the operation was negligently performed, he claims that (1) he should have been informed of the risks associated with such an operation, and (2) the operation was not necessary.
