QUESTIONS reserved by the Superior Court in and for New Castle county, for hearing before all the judges in the Court of Errors and Appeals. The actions were in assumpsit for goods sold and delivered to the defendant's intestate, being for the price of certain lotterytickets. There was a special count for the price of lottery tickets sold;, and a count on an account stated with the intestate. The pleas were non-assumpsit, payment, discount, set off, and limitation.
At the trial below the plaintiffs offered in evidence a copy of their account, with a probate by one of the members of the firm.…
