Plaintiff was the- holder of co-unty warrants, which were called by defendant, treasurer of Davison county. On presentation of the warrants for payment the treasurer issued' a check upon funds in the First National Bank and delivered the check to plaintiff in the evening about 5 o’clock of the nth of October, 1923. On the 13th of October plaintiff deposited the check as a cash item with the Commercial Trust & Savings Bank.
