JOYCE, District Judge.

This case was tried before the court on a stipulation of facts, deposition, and certain exhibits, and briefs of the respective parties.

Briefly, the facts are: Mary LaCourse resided in Herman Township, St. Louis County, Minnesota, and was a victim of the devastating'forest fire which swept northeastern Minnesota on October 12, 1918, destroying an area of between 1,500 and 2,000 square miles, with resulting damage said to *531have approximated $40,000,000 and the loss of 500 lives.
