DECISION AND ORDER

STADTMUELLER, District Judge.

Plaintiffs instituted this lawsuit on May 12, 1988, as a class action for declaratory and injunctive relief pursuant to 42 U.S.C. § 1983 and 28 U.S.C. §§ 2201 and 2202, alleging that defendants have violated their constitutional rights as guaranteed by the Fifth and Fourteenth Amendments to the United States Constitution. Defendants, Ronald Feidler and Joseph Sweda, (hereinafter either “defendants” or “state”) are respectively, the Secretary of the Wisconsin Department of Transportation and Wisconsin Commisioner of Transportation, and are sued in…
