Appellee was- indicted by the grand jury of Jackson County for violation of the statutes of this State which make it unlawful for persons or corporations to contract for the purchase or sale of certain commodities for future delivery without intention to make actual delivery, and which make it unlawful for any telegraph or telephone company to knowingly receive for transmission any messages relating to such purchase or sale. The court sustained a demurrer to the indictment, and the State appealed.
