This action was brought by appellee, Charles A. Zahringer, for the recovery of wages due him as an employee of appellant, MeCoy-Couch Furniture Company, and for a penalty for the nonpayment thereof under the provisions of § 9111 of Pope’s Digest. Upon trial to a jury, the evidence tended to establish the following facts:
