HARRIS, Judge.
Hernandez was convicted for transporting marihuana and sentenced to a term of fifteen (15) years in the penitentiary.
On the morning of June 16, 1969, appellant drove his Chrysler automobile to a service station on the Halls Mill Road in Mobile, Alabama. The service station building was being painted at the time and there were several painters on the premises. Appellant drove away and returned several times.
