MEMORANDUM OPINION AND ORDER
PRATT, District Judge.
For the third time since this case was removed from the Iowa District Court for Scott County, this Court has before it one of the various incarnations of Defendants’ Motion For Summary Judgement. To characterize the matter as fully submitted is a gross understatement, but such will suffice for now.
