The defendant, á married man, 53 years of age, was charged with the murder of his wife on the 3d day of October, 1934.

On the 18th day of October, 1934, the defendant, after having been duly arraigned and being present in court and represented by counsel, entered a plea of guilty as charged. Thereupon, the court, in compliance with section 12913 of the Code, fixed Tuesday, October 23, 1934, as the time for the hearing of evidence before imposing sentence.
