— The defendant was charged in an indictment returned by the grand jury of Pottawattamie county with the crime of first-degree murder. It was therein alleged that the defendant, C. R. Bruntlett, on or about the 8th day of December, 1947, while in the perpetration or the attempt to perpetrate the robbery of Percy Smith, wilfully, deliberately and with malice aforethought killed him. The defendant later entered a plea of guilty. The court thereafter heard evidence for the purpose of ascertaining what the punishment should be. A sentence of death by hanging was imposed.
