Appeal "by the defendants, Thomas L. Feitner and others, as commissioners, etc., from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 1st day of August, 1906, reducing the assessment for the purposes'of taxation for - the year 1899 on the real property of the relator.

McLaughlin, J.:
1 The relator to review assessments- for the purpose of taxation in the year 189.9 on certain real estate in'the city of New York, *453obtained upon a petition a writ of certiorari. The real estate and the assessments thereon were 211-219 Bleecker street, $42,000.; 105 East Ninth street, $12,500 ; 744 Broadway, $175,000 ; and the petition asked that the assessments be reduced to $32,000, $10,000 and $131,000 respectively.
