This is the second appearance of this cause on appeal to this Court. The case was formerly here on demurrer in Tillman, et al. v. Richton Tie & Timber Co., cause No. 39,687, reported in 224 Miss. 789, 80 So. 2d 745. The trial court had sustained the demurrer, and we reversed the case on the ground that the allegations of the bill of complaint and the exhibits thereto were sufficient to state a cause of action.
