The accused, the Southern Express Company, was tried and found guilty, in the superior court of Whitfield county, of selling spirituous liquors contrary to law, upon the following state of facts: “A shipper in the State of North Carolina sent a package of whisky containing two gallons, through the defendant company, to be delivered to the consignee at Dalton, Whitfield county, Ga., on his payment for the same to the defendant’s agent *227at Dalton, together with the charges thereon.
