The defendant, Brian Niblack, was charged in an original information with the crime of murder in violation of General Statutes § 53a-54a,1 and, in an additional information, with the crimes of escape from custody in violation of General Statutes § 53a-171, and kidnapping in violation of General Statutes §§ 53a-92 (a) (2) (B) and 53a-8. On September 15, 1988, the trial court, Quinn, J., held a hearing pursuant to article first, § 8 of the Connecticut constitution as amended,2 and General Statutes *273§ 54-46a3 to determine whether there was probable cause to prosecute the defendant for the crime…
