Arnold-Burger, J.:

The State charged Timothy Webb with first-degree murder and criminal possession of a firearm. The juiy convicted Webb of the firearm charge, but it failed to reach a verdict on the murder charge. Without any objection from Webb, the district court declared a mistrial. Shortly thereafter, Webb filed a motion to dismiss. The district court denied the motion, and Webb appeals. Because we find that Kansas statutes clearly only allow an appeal in the case of a final judgment, which requires a conviction and sentence, we lack jurisdiction at this time to consider Webb s double…
