Demurrer to a defense setting up new matter in an action for false representations.

This is a demurrer for insufficiency interposed to alleged new matter set up as a defense. The action is for damages claimed to have been sustained by the plaintiff because of defendant’s false representations as to the financial condition of a certain corporation and the sale by the defendant to the plaintiff of certain shares of stock in said corporation.
