This was an action of book debt, brought against the defendant, by his former wife, after they had been divorced, to recover for the education and support furnished by her to their minor children. At the superior court, for Fairfield county, holden in October, 1851, an auditor was appointed, to adjust the accounts between the parties, who, after a hearing before him, found and reported, that the defendant was indebted, and owed to the plaintiff $126.96. In the discussion of this case, we may

allude to principles not necessarily involved in its decision; but we wish to determine definitely no other question than the one presented by the record before us; and this is, whether the mother of these children can sustain this action at law, against her divorced husband, to recover the entire expense of their support, furnished by her, upon the claim, that he alone is liable for it, under the peculiar circumstances of this case.
