OPINION

BLISS, Judge:

The Appellant Randall Dewayne King, hereinafter referred to as defendant, was charged, tried before a jury and convicted of the offense of Unlawful Possession of Marijuana With Intent to Distribute in the District Court of Kiowa County, Case No. CRF-75-36. Punishment was assessed at a term of two (2) years under the direction and control of the Department of Corrections of the State of Oklahoma and a One Thousand Dollar ($1,000.00) fine. The trial court subsequently suspended one year of the sentence. The defendant has perfected his timely appeal.
