Kapnick, J.), entered December 8, 2004, which, in an action for employment discrimination, upon renewal, vacated plaintiffs default in opposing defendant’s motion to dismiss the complaint pursuant to CPLR 3126, and denied such motion upon condition that plaintiffs attorney pay defendant $500, unanimously modified, on the facts, to increase the amount to $1,000, payable within 20 days of service of a copy of this order with notice of entry, and otherwise affirmed, without costs.
