The first question demanding attention is -defendant in error’s cross-assignment, to the effect that the county court was in error in overruling their motion to dismiss the writ of certiorari granted upon plaintiff in error’s petition, by .which the case was brought into the county court of Wichita county from the justice court of precinct'No. 2 of that county. The defendants in error instituted suit against the plaintiff in error and the Missouri, Kansas & Texas Railway Company in the justice court for damages.
