Suit was filed in the Civil Court of Record of Dade County by Therrell as Liquidator against R. F. Smith as stockholder of Bank of Bay Biscayne to enforce the payment of 100% assessment made by the Comptroller against stockholders of the defunct bank. It was alleged that on and before January 31,- 1930, the defendant was the owner of 20 shares of the capital stock of the Bank of Bay Biscayne.
