Plaintiff, Paxton-Mitchell Company, filed this action against its insurance carrier, Royal Indemnity Company, to recover defense expenses and damages paid to satisfy the judgment in a prior action. The trial court entered findings and judgment in favor of plaintiff, and defendant appeals.
Plaintiff manufactures mobile cranes called "Snoopers” which are installed on vehicles and are used to paint the undersides of bridges. In 1971, Frank Klaas pin-chased a Snooper from plaintiff and also purchased a 1967 Ford flatbed truck from a Ford agency in Omaha, Nebraska. The cost of the truck was…
