On August 26, 2008, Plaintiff CNH America, LLC (“CNH” or “company”) initiated this action against Defendant International Union, United Automobile, Aerospace and Agricultural Implement Workers of America (“UAW” or “union”). In its Complaint, CNH alleges that the UAW breached the terms of a collective bargaining agreement which CNH claims released it of liability for certain retiree health insurance benefits.
