When this case was first before the Circuit Court of Appeals it was stated in the opinion which was then delivered that the case showed that the railroad company was in possession of a large wharf, built at its own expense, “ on the extension of a public street in the city of Pensacola into the' deep waters of the harbor of the city.” On looking at the record before us we find in the pleadings no averment that the wharf in question was in fact built as such an extension.
