Appeal, by permission, from an order of the Supreme Court (Teresi, J.), entered December 8, 2006 in Albany County, which denied defendant’s motion pursuant to CEL 440.10 to vacate the judgment convicting him of the crimes of attempted murder in the first degree, attempted assault in the first degree (four counts) and reckless endangerment in the first degree, without a hearing.
