Respondents-Appellants Michael McGinnis, Superintendent of the Southport Correctional Facility, and Eliot Spitzer, New York State Attorney General, appeal the December 2, 1998, judgment of the United States District Court for the Southern District of New York (Denny Chin, Judge), which conditionally granted Petitioner-Appellee Ronald Mask’s petition for habeas corpus unless: (1) Mask’s sentence is reduced to a term of eight to sixteen years; or (2) Mask is granted a new trial.
