The plaintiffs brought this action in contract and tort against the defendant Melrose-Wakefield Hospital Association (the hospital) for damages arising from water damage to their property located at 87 Rowe Street in Mel-rose. A judge of the Superior Court denied the plaintiffs’ mo*173tian to amend their complaint to add a claim under G. L. c. 93A, and, after the equivalent of the plaintiffs’ opening statement, purported to direct a verdict for the hospital. The plaintiffs have appealed.
