This is an action for declaratory judgment and to-quiet title filed by the plaintiffs against the defendant, the Village of Brookville.

It appears that Elgar Weaver and Elizabeth Z. Weaver, husband and wife, for the sum of one dollar and other valuable considerations to them paid by the Village of Brookville, Montgomery County, Ohio, an incorporated municipality under the laws of the State of Ohio, granted by quit claim deed to the said Village of Brookville, its successors and assigns forever, the 25 and 45 acre tracts of land, more particular described in the petition…
