Didier v. Drexel Chemical Co.

We are asked in this case to revisit the preemptive reach of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) in Washington in light of a recent United States Supreme Court opinion, Medtronic, Inc. v. Lohr, 518 U.S. 470, 116 S. Ct. 2240, 135 L. Ed. 2d 700 (1996). We conclude that Medtronic does not change the holding reached by our Supreme Court that FIFRA preempts state common-law causes of action based on labeling. All-Pure Chem. Co. v.
