This Proceeding is before the Court on the Motion for Summary Judgment and Alternative Motion to Dismiss filed by Au-dere C. Inman (“Defendant”) on November 13, 2000. (Doc. 9.) On November 30, 2000, Cardservice International, Inc. (“Plaintiff’) filed a Motion for Telephone Hearing in response. (Doc. 12.)
