Petitioner, Downtown Cluster of Congregations, petitions for review of an order of the District of Columbia Board of Zoning Adjustment (Board) granting intervenor, the F Street Real Estate Company, a use variance under the provisions of 11 DCMR §§ 1702.4, 1 3107.2 (1994). 2 The variance permits the conversion of a building formerly occupied as a department store of Julius Garfinckel & Company (Garfinekel’s) to mixed-use office, retail and service.
