In an action, inter alia, to recover damages for legal malpractice and breach of contract, the plaintiff appeals from an order of the Supreme Court, Westchester County (Lefkowitz, J.), entered January 16, 2013, which granted the defendant’s motion to dismiss the complaint pursuant to CFLR 3211 (a) (1) and (7).

*775Ordered that the order is modified, on the law, by deleting the provision thereof granting that branch of the defendant’s motion which was to dismiss the second cause of action, and substituting therefor a provision denying that branch of the motion; as so modified, the order is…
