FINDINGS OF FACT AND CONCLUSIONS OF LAW

Plaintiff commenced this action seeking to recover for alleged violations of the Fair Debt Collection Practices Act, 15 U.S.C. § 1692, el seq., (“FDCPA”) by defendant Midpoint Resolution Group, LLC (“Midpoint”) and its employee, David Constantine (Dkt. # l). 1 The case was initially referred to me by Hon. Richard J. Arcara to conduct “all pre-trial matters,” including “hearing and disposition of all non-dispositive motions” and to “hear and report upon dispositive motions” (Dkt. # 5).
