OPINION OF THE COURT

Hodge, Chief Justice.
Gent Mosby appeals from the Superior Court’s October 30, 2015 opinion and order, which denied his petition for writ of habeas corpus as procedurally barred. For the reasons that follow, we reverse.
I. BACKGROUND
On January 2, 1996, the Government of the Virgin Islands charged Mosby and four co-defendants with several offenses related to the death of Stephen Hodge.
