In this action, plaintiff, which develops and markets proprietary structured finance transaction strategies, seeks to recover damages that it alleges it suffered as a result of defendant’s utilization of one such strategy in violation of an agreement between the parties. In particular, plaintiff Structured Capital Solutions, LLC (“SCS”) seeks to recover damages for breach of contract, unjust enrichment, misappropriation of trade secrets, and fraud.
