This case comes before us on a writ of error from the Circuit Court of St. Louis county. The plaintiff brought his action against the defendants, who were judges of an election held in the city of St. Louis on the 7th day of November, 1865, for rejecting his vote, and claimed damages in the sum of ten thousand dollars.
