“This suit was brought by Earsell Moss to set aside an award of the Industrial Accident Board of the State of Texas on his claim for compensation for injuries allegedly sustained by him on the 20th day of March, 1935, while in the course of his employment for the National Lumber & Creosoting Company of Texarkana, Texas ; which injuries, allegedly rendered him totally and permanently incapacitated from performing work or labor.
