ORDER GRANTING DEFENDANT’S MOTION FOR SUMMARY JUDGMENT
RYSKAMP, District Judge.
THIS CAUSE is before the Court upon Defendant’s Motion for Summary Judgment [DE 18], filed February 13, 2001. Defendant filed a Response [DE 27] on April 2, 2001, and Plaintiff filed a Reply [DE 29] on April 10, 2001. A hearing on this matter was held before this Court on April 24, 2001. Plaintiffs motion is now ripe for consideration.
