This appeal, as presented, involves many interesting questions, but for reasons which we shall presently show, they will not be discussed separately.
By an original petition, filed February 7th, 1936, National Bondholders Corporation, alleged to be a Delaware corporation, with permit to do business in Texas, sued C. A. Foster and his wife, Blanche Foster, for $1,477.68, with interest at 8.15 per cent per annum since May 1st, 1934, and ten per cent attorney’s fees, alleging the principal sum asked was a balance due and unpaid on a note, dated August 8th, 1927, in the principal…
