Appeal from Jackson Criminal Court. — lion. E. E. Porterfield, Judge. (1) The conduct of the assistant prosecuting attorney, in his closing argument to the jury, was of the most flagrant and reprehensible type. It was calculated to and did arouse the passions and prejudice of the jury, and inflamed their minds, and it was highly prejudicial and injurious to the rights of this defendant, and constitutes reversible error in this case.

The prosecuting attorney of Jackson county filed an information charging appellant and one Samuel Sherman with murder in the 'first degree in that they shot and killed one John Lynch, April 30, 1913. A severance was granted, and appellant was tried, resulting in his conviction for murder in the first degree, his punishment being fixed at death. From this judgment he appealed to this court.
