From the record in this cause, it appears that in the latter part of August, 1888. the appellant, James M. Wator-bury, owner of the steamship Progreso, then on a voyage from Cuba to the United States, did, through his agents, Bsiloni & Co., of New York city, by a certain charter party, demise and let to freight his said steamship Progreso to the firm of Street Bros., of Charleston, the appel-lees.
